&lt;p&gt;This article describes Imam al-Shāfi'i thought in building istinbath Islamic law method and its decition's which evolved from qawl qadīm to qawl jadīd. He is known as the founder of uṣūl al-fiqh science which is arranged systematically-logically and critically. He tried to combine the two schools of thought, those are: Maliki, known as ahl al-ḥadīth that thrives in the Hijaz, and the Hanafi, known as ahl al-ra'y that is entrenched in Iraq. He managed to combine the two schools by taking method good ahl al-ḥadīth and leaving the less ones successfully. Reciprocally, he took the good ahl al-ra’y method and left the poor. It was done for the reason that he had studied with Imam Malik and Muḥammad ibn Ḥasan al-Shaibani, the adherents of the Hanafi schools. The fatwa which he formulated at his living in Iraq is known as qawl qadīm. After he reviewed the fatwa built in Iraq and found the fragility of the arguments as a fundamental, finally, he triggered a new law, namely qawl jadīd which was based on the strong arguments.&lt;/p&gt;

&lt;em&gt;This study aims to discuss LGBT phenomenon in Indonesia in Islamic law, human rights (HAM), and psychological prespectives. In general, this controversy can be classified into three perspectives, First, religious classification that represented by religious prominent figures and religious organizations particularly Islam, the second, both activists and human rights activists, and the third, psychologist profession. According to the psychological perspective, LGBT is a disease that has a possibility to be cured. According to Islamic law and human rights, LBGT groups must be protected in the form of health insurance by helping and treating them from the disease to be normal. But, the LGBT community activities that contradict with religious norms and interfere the other human rights, then according to the Islamic law and human rights perspectives, such activities should be banned, even they can be subjected to sanctions.&lt;/em&gt;

&lt;p class="IABSSS"&gt;Ethnooceanography and the intersection of &lt;em&gt;shar'i&lt;/em&gt; aspects to determination of the early of Ramadan and Shawwal by Joguru Sultanate of Tidore.&lt;em&gt; &lt;/em&gt;The determination of the early of the new month of Ramadan and Shawwal was very important for Muslims because it is related to the time of worship. Judge syara 'The Sultanate of Tidore (Joguru) has long applied the method of determining the early month of Hijri (Ramadan and Shawwal) through tidal movement observed on "akebai" included in ethooceanography and called Joguru Method (MJ). Hilal that has never been seen in Tidore and its surrounding areas in the long-term cycle of moon (34 years) caused its early moon to be inapplicable due to non-fulfillment of the requirement of hisab (hadith). MJ makes observation (rukyat) change of tidal movement on "akebai" is "&lt;em&gt;ijtihād&lt;/em&gt;". The appropriateness of the scientific aspects of ethnoocaenography and the intersection of the &lt;em&gt;shar'i&lt;/em&gt; aspects make it a comparative method of determining the beginning of the new month of Hijri in astronomy (&lt;em&gt;hilāl&lt;/em&gt;). Required the expansion of the meaning of the “&lt;em&gt;hilāl&lt;/em&gt;” as an indicator of the beginning of the month of the Hijri calendar.&lt;/p&gt;&lt;p class="IABSSS" align="center"&gt;[]&lt;/p&gt;&lt;em&gt;Ethnooceanography&lt;/em&gt; dan titik temu aspek Syar’i dalam penentuan awal bulan Ramadhan dan Syawal oleh Joguru Kesultanan&lt;em&gt; &lt;/em&gt;Tidore. Penentuan awal bulan baru Ramadhan dan Syawal sangat penting bagi umat Islam karena berkaitan dengan waktu ibadah. Hakim syara’ Kesultanan Tidore (Joguru) telah lama mengaplikasikan metode penentuan awal bulan baru Hijriah (Ramadhan dan Syawal) melalui pergerakan pasang surut yang terpantau pada “akebai” termasuk dalam e&lt;em&gt;thooceanography &lt;/em&gt;dan disebut dengan Metode Joguru (MJ)&lt;em&gt;. &lt;/em&gt;Hilal yang tidak pernah terlihat di wilayah Tidore dan sekitarnya selama siklus jangka panjang (34 tahun) menyebabkan hisab awal bulan tidak dapat diaplikasikan akibat tidak terpenuhinya persyaratan hisab (hadis). MJ melakukan peng­amatan (rukyat) perubahan tinggi air pada “akebai” adalah “ijtihad”. Terdapat ke­sesuaian aspek sains dari &lt;em&gt;ethnoocaenography&lt;/em&gt; serta titik temu aspek syar’i yang menjadikan MJ berpotensi sebagai metode utama sekaligus sebagai metode pem­banding dari metode umum dalam penentuan awal bulan baru Hijriah. Diperlukan perluasan makna kata “hilal” sebagai indikator awal bulan baru penanggalan Hijriah.

&lt;p class="IABSSS"&gt;&lt;span lang="NL"&gt;This article aims at describing &lt;em&gt;ḥifẓ al-dīn&lt;/em&gt; concept in Dermolo Village Jepara and its philosophical basis. Religion upholding (maintenance) as &lt;em&gt;maqāṣid al-sharī’ah&lt;/em&gt; in Dermolo villagers is constructed through noble/ultimate value systematization from cultural hero. Religion is placed as a way of life and is not framed as unorgani&lt;/span&gt;&lt;span lang="EN-US"&gt;z&lt;/span&gt;&lt;span lang="NL"&gt;ed religion. This is the form of religion upholding sourced from social text, in which their religiosity motivation are influenced by academic and economic level factors of the society. This form then metamorphs/change into organized religion sourced from written text of holy book as the result of ideological and cultural migration of migrants. The difference of these two types of religions has religiosity paradigm impicitation to its adherents; the first one is accommodative and the other one&lt;/span&gt;&lt;span lang="NL"&gt;is justificative. This article serves the implementation of &lt;em&gt;ḥifẓ al-dīn&lt;/em&gt; concept as a result of &lt;em&gt;maqāṣid al-sharī’ah&lt;/em&gt; transformation from orthodoxy to &lt;/span&gt;&lt;span lang="EN-US"&gt;contemporary&lt;/span&gt;&lt;span lang="NL"&gt; practuced by the society in Dermolo Village..&lt;/span&gt;&lt;/p&gt;&lt;p class="IABSSS" align="center"&gt;&lt;span lang="NL"&gt;[]&lt;/span&gt;&lt;/p&gt;&lt;p class="IABSSS"&gt;&lt;span lang="NL"&gt;Artikel ini bertuju&lt;/span&gt;&lt;span lang="EN-US"&gt;a&lt;/span&gt;&lt;span lang="NL"&gt;n menggambarkan konsep &lt;em&gt;ḥifẓ al-dīn&lt;/em&gt; pada Desa Dermolo Jepara dan landasan filosofisnya. Pemeliharaan Agama (&lt;em&gt;ḥifẓ al-dīn&lt;/em&gt;) sebagai &lt;em&gt;maqāṣid al-sharī’ah&lt;/em&gt; pada masyarakat Desa Dermolo dikonstruksi melalui sistematisasi nilai-nilai luhur yang diwarisi secara turun-temurun (&lt;em&gt;ultimate value&lt;/em&gt;) dari &lt;em&gt;cultural hero.&lt;/em&gt; Agama ditempatkan sebagai &lt;em&gt;way of life &lt;/em&gt;dan tak terbingkai dalam wadah organisasi (&lt;em&gt;unorganized religion&lt;/em&gt;). Inilah bentuk pemeliharaan agama yang bersumber dari teks sosial (&lt;em&gt;social text&lt;/em&gt;), dimana motivasi keberagamaannya dipengaruhi oleh faktor tingkat pendidikan dan ekonomi masyarakatnya. Bentuk ini lalu bermetamorfosa menjadi agama organisatoris (&lt;em&gt;organized religion&lt;/em&gt;) yang bersumber pada teks kitab suci (&lt;em&gt;written text&lt;/em&gt;) sebagai hasil migrasi ideologis dan kultural masyarakat pendatang. Perbedaan kedua jenis agama ini berimplikasi pada paradigma keberagamaan pemeluknya, yang pertama bercorak akomodatif, sementara yang kedua bercorak justifikatif. Critique of uṣūl al-fiqh literacy is very crucial. The scarcity of critique can lead to the risk of intellectual stagnation and an inability to address the legal needs of a constantly changing society, simultaneously causing a lack of resonance with reconstructive ideas. The study aims: 1) to explore evidence of the scarcity of studies criticizing uṣūl al-fiqh from 1890 to 2023; 2) to explain the factors influencing the scarcity of critical works, and 3) to propose steps for the reconstruction of uṣūl al-fiqh. The data sources for this article are works collected from web publishers, digital libraries, and search engines. The data obtained was mapped and analyzed, and its trends were recorded. This study finds that during the period 1890-2023, criticism was the rarest aspect in uṣūl al-fiqh literature. The factors causing the scarcity of critique vary and complement each other, involving scholarly elements, uṣūl al-fiqh factors, and surrounding policies. Although criticism of uṣūl al-fiqh is relatively rare, it does not mean there is no space for reconstruction. Through this study, readers can understand the recent developments in uṣūl al-fiqh and assess the extent to which criticism has been undertaken while reflecting on how reconstruction can be initiated once again.

The Critique toward Uṣūl al-Fiqh Literacy of 1890–2023: An Offer for Development

1890-2023年伊斯兰教法学原理识读批判：发展之献议

Law Number 33 of 2014 and Government Regulation Number 31 of 2019 in Indonesia shifted halal certification from voluntary to mandatory on October 17, 2019, contrasting with Malaysia's voluntary system under the 2011 Akta Perihal Dagang (APD). This study aims to scrutinize the legal regulations of halal certification in both countries and assess their impacts on business entities. Employing a qualitative method with a phenomenological approach reveals differences in certification procedures, notably in application-to-issuance stages. Indonesia provides a self-declaration mechanism for micro and small businesses, while Malaysia lacks such a provision. Nonetheless, material inspection principles align in both nations. Most respondents perceive halal certification as crucial for sales turnover, despite challenges posed by the COVID-19 pandemic. This research is significant for businesses and governments on how to manage halal certification in both countries.

Legal Effectiveness of Halal Product Certification in Improving Business Economics in Indonesia and Malaysia

The rights of women and children after divorce are often neglected. The article examines the reality of children's and women's rights in Pekalongan City, Central Java, Indonesia, focusing on the causes of non-fulfillment and the legal consequences. Data from 10 court decisions from the Pekalongan City Religious Court revealed a gap between post-court decision reality and the fulfillment of these rights. The research found that the non-fulfillment of children's and women's rights after divorce in Pekalongan is due to a lack of public knowledge about post-divorce execution procedures and related rights. The difficulty of spouses in ensuring the fulfillment of these rights is also reflected in the lack of application of Islamic legal knowledge on the obligation to provide maintenance by husbands. The legal consequences are devastating, emphasizing the need for improvements in the legal system, increased public knowledge, and the application of Islamic legal principles.

The housing business continues to grow along with the increasing need for the fulfillment of housing. This research delves into the application of mushārakah mutanāqiṣah in housing finance within Indonesia and Malaysia, scrutinizing their regulations and relevant governing institutions. Employing a normative legal approach, it explores legal principles, systematics, synchronization, and historical context about this financing method. Employing inductive, deductive, and comparative methods, it analyzes regulations and practices in both countries. By offering insights into the potential and challenges of implementing mushārakah mutanāqiṣah in housing finance, the study aims to provide recommendations for regulatory enhancements, fatwa institutions, product development, and adherence to sharī’ah principles. This research is crucial for deepening understanding and facilitating improvements in various sectors related to housing finance within the context of Islamic finance in Indonesia and Malaysia.

Mushārakah Mutanāqiṣah (Diminishing Partnership) Regulation for Housing Finance in Indonesian and Malaysian Law

The joint property division in Article 97 of the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI) is one-half (1/2) as long as it is not specified otherwise in the marriage agreement. This is followed mainly by judges because of the legal certainty in it, but not for wives with double burdens who work to earn a living and are also housewives. This research aims to reconstruct the joint property division through jurimetrics analysis to obtain more objective and tested results because it is based on empirical data. This research is a normative law study with a descriptive approach. The data in this study are the Compilation of Islamic Law, and concepts, as well as other laws and regulations related to the joint property division analyzed with jurimetrics to get the ideal formulation and scale of division. The results obtained include several models of joint property division for wage-earner wives (breadwinners) along with the scale of formulation which are divided into two groups, namely the joint property division with a share of one-half for the former husband and wife and the joint property division with a share other than one-half for the former husband and wife according to the role taken by both. This research can be used as a reference by judges in deciding cases of joint property, especially related to the condition that a wife is a wage-earner.
