Non-union collective agreements are central to the architecture of the Fair Work Act 2009 (Cth) (FW Act). This legislative architecture has facilitated the practice of employers creating single-enterprise agreements with their employees with no negotiation or bargaining and no involvement of unions, and in circumstances where employees have been denied the benefit of receiving safety net modern award pay and conditions, sometimes for decades. The paper explores the impact on the creation of non-union agreements of recent legislative amendments to the FW Act. The paper argues that the amendments were designed to expand the coverage of collective agreements by seeking to overcome problems with the operation of collective agreement-making and introducing new forms of multi-employer agreement-making, in which unions play a more central role. Unions have been active in using the legislative amendments in a number of respects. However, despite some positive outcomes, the lack of changes to the underpinning architecture of the Act means that employers are still able to avoid unions and use non-union agreements to undermine the terms and conditions negotiated in union agreements and set out in minimum standards. These problems will continue until the FW Act is changed in more fundamental ways.

At a turning point: work, care and family policies in Australia

This study explores how Chinese Buddhist business owners navigate the intersection of their professional and religious identities and how this shapes their perceptions of career success. Through qualitative interviews with 31 Buddhist Chinese business owners, we introduce the concept of 'identity synchronisation' to explain how individuals manage multiple, potentially conflicting identities. Our findings reveal that participants maintain distinct yet mutually reinforcing professional and religious identities, leading to a holistic conceptualisation of career success encompassing both material achievements and spiritual fulfilment. This process of identity synchronisation influences ethical decision-making, leadership approaches, and definitions of success. Our analysis extends social identity theory by demonstrating how individuals actively synchronise seemingly disparate identities, challenging the notion that work and religious identities are inherently conflicting. The study contributes to understanding how religious identity shapes work experiences in diverse business contexts and offers insights for organisations supporting multiple identity expressions. It provides a foundation for exploring how diverse identities influence workplace dynamics in an increasingly globalised environment.

Integrating professional and religious identities: implications for career success and workplace dynamics in China

This paper investigates the contemporary landscape of last-mile logistics workplaces in relation to the human aspects of labour strategies. The study examines how couriers navigate their territorial environment, develop tacit knowledge and streamline their tasks to meet company objectives and enhance their own efficiency. By proposing the term 'territorial labour', we underscore the interplay between socio-spatial dynamics, technological applications, and couriers' agency in the workplace. Our study shows how last-mile delivery uses territorial labour to create a work model that encompasses high control with no direct and explicit supervision. Couriers have the agency to deploy a range of methods in sorting parcels, sequencing deliveries and pickups, and handling client relationships – all embedded in a territorial context and dependent on their locale-specific knowledge. In contrast to prevailing streams of work and labour literature on logistics that exemplify the potential to digitise and automate work, our findings demonstrate that human labourers occupy a crucial position in the logistics value chain. This finding opens avenues for future research beyond the logistics industry, where territorial labour might be relevant in discussions of the transformation of work.

Territorial labour and worker agency: a case study of delivery couriers in first/last mile logistics in Poland

Digitalisation has made algorithmic management a defining feature of platform work. This study explores the psychosocial stresses and risks associated with different algorithmic management practices and analyses the applicability of Job Demand-Control-Support model in examining food delivery platform work. Our findings draw from 30 semi-structured interviews with platform food couriers in Finland. We applied Job Demand-Control-Support framework as the analysis matrix to inductive qualitative content analysis and compared the algorithmic management practices of the two dominant food delivery platforms in Finland. This study established that algorithmic management had direct and indirect intertwined negative psychosocial influence on couriers. These impacts were varied and were related to how algorithmic management was employed by the platforms. We also found that algorithmic management can increase work demands, decrease couriers' control over their work, and limit workplace support. The study demonstrated that Job Demand-Control-Support model is suitable for analysing stress related to algorithmic management and platform work. This supports its application in future quantitative analyses. Our study deepens the understanding of psychosocial issues associated with the emerging trend of algorithmic management in workplaces, which is a fundamental dimension of the future of work. It highlights the need for regulatory measures relevant in ensuring healthy work environments.
