espanolEl orden publico es una de las instituciones mas conocidas e importantes del Derecho internacional privado. Puede encontrarse como motivo de denegacion de reconocimiento y ejecucion en varios Reglamentos europeos, entre otros en el Reglamento (UE) 2016/1103 del Consejo, de 24 de junio de 2016, por el que se establece una cooperacion reforzada en el ambito de la competencia, la ley aplicable y el reconocimiento y la ejecucion de las resoluciones en materia de regimenes economico matrimoniales, y en el Reglamento (UE) 2016/1104 del Consejo, de 24 de junio de 2016, por el que se establece una cooperacion reforzada en el ambito de la competencia, la ley aplicable y el reconocimiento y la ejecucion de las resoluciones en materia de efectos patrimoniales de las uniones registradas, denominados conjuntamente “Reglamentos Gemelos”. En concreto, ambos determinan que no se reconocera una resolucion si dicho reconocimiento es manifiestamente contrario al orden publico del Estado miembro en el que se solicita el reconocimiento. El articulo estudia las caracteristicas de los motivos de orden publico y hace hincapie en los problemas relacionados que son especificos en el contexto de los “Reglamentos Gemelos”. EnglishPublic policy is one of the most well-known and important institutions of private international law. It can be found as grounds for refusal for recognition and enforcement in several European Regulations, among others also in the Council Regulation (EU) 2016/1103 of 24 June 2016 implementing enhanced cooperation in the area of jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes and Council Regulation (EU) 2016/1104 of 24 June 2016 implementing enhanced cooperation in the area of jurisdiction, applicable law and the recognition and enforcement of decisions in matters of the property consequences of registered partnerships, together named as Twin Regulations. They namely both determine that a decision shall not be recognised if such recognition is manifestly contrary to public policy (ordre public) in the Member State in which recognition is sought. The article studies the features of grounds of public policy and emphasises the related problems that are specific in the context of the Twin Regulations.

Mas concretamente, la atencion se centra en los problemas hermeneuticos que surgen tanto a nivel de la legislacion europea como a nivel de la disciplina nacional italiana que es aplicable segun los criterios de conflicto europeos, mostrando las ambiguedades y amplias areas de sombra dejadas al descubierto por esta ultima. EnglishThe essay focuses on the discipline of the work done by one partner in the company of the other in cross-border couples and on the problems involved in this case. More specifically the focus is on the hermeneutical problems that arise both at the level of European legislation and at the level of Italian national discipline which is applicable according to European conflict criteria, showing the ambiguities and wide areas of shadow left uncovered by the latter.

espanolLos Reglamentos (UE) 2016/1103 y 2016/1104 brindan a los conyuges y unidos la posibilidad de celebrar acuerdos para la organizacion de su regimen patrimonial, pero no detallan su contenido y estructura. Ademas, si bien la posibilidad de celebrar esos acuerdos, incluso antes del matrimonio o la celebracion de una union registrada es una innovacion valiosa en comparacion con otros reglamentos europeos en materia de familia, es probable que algunas decisiones tomadas por el legislador europeo sobre la ley aplicable sean fuente de inconvenientes. Ademas, en cuanto a su reconocimiento y ejecucion en los Estados miembros participantes- que se basaran en las mismas normas dictadas para las decisiones, los documentos publicos y las transacciones judiciales- debe prestarse atencion a su admisibilidad en algunos de ellos, como Italia, donde la jurisprudencia del Tribunal Supremo se opone firmemente a su aceptacion. EnglishRegulations (EU) 2016/1103 and 2016/1104 provide spouses and partners with the possibility to conclude agreements for the organization of their property regime but do not detail their content and structure. Moreover, while the possibility to conclude those agreements even prior to the marriage or the conclusion of a registered partnership is a valuable innovation in comparison with other European Regulations in family matters, some choices made by the European legislator on applicable law will likely be source of inconveniences. Furthermore, as for their recognition and enforcement in the participating Member States – which will be based on the same rules enacted for decisions, authentic instruments, and court settlements – attention should be paid to their admissibility in some of them, like Italy, where the jurisprudence of the Supreme Court is steadily opposed to their acceptance.

espanolLa discusion en torno a la teoria de la inexistencia en el derecho chileno presenta diversas posturas. Hay quienes estan a favor de concebir la inexistencia como sancion y muchos que la niegan tajantemente; e incluso, algunos innovadores que toman una posicion eclectica frente al tema. Asimismo, los Tribunales Superiores de Justicia chilenos no han podido ponerse de acuerdo en este tema, en donde existen fallos que acogen la teoria, la rechazan, o simplemente la confunden. EnglishThe discussion around the theory of non-existence in Chilean law presents different positions. There are those who are in favor of conceiving non-existence as a sanction and many who strongly deny it; and even some innovators who take an eclectic position on the subject. Likewise, the Chilean Superior Courts of Justice have not agreed on this issue, and there are rulings that accept the theory, reject it, or simply confuse it.

In the present work, the author studies two different topics, although related to the dilemma of placing animals and robots between people and things, with the consequent practical repercussions that this entails. Regarding animals, bearing in mind that, according to the new social and legal reality, they are sentient beings, without the need to personify them, but without admitting that they are simple things, the author considers that that reality makes animals a type of good or object of special law, deserving of a unique protection, but without the need to create any hybrid category between people and things, between subjects and objects of law. In another order, the author considers that robots –even– with artificial intelligence are not –today at least– people, but simple things, but he proposes –based on some Resolutions of the European Parliament– that in the future robotics may show a founding personality.
